01Agreement to these terms
These Terms of Use form a binding agreement between you and Fitcharge concerning the public website. Specific purchased services may add separate scopes, statements of work, or invoices; where conflict arises, the more specific written contract prevails for that transaction only.
02Eligibility
The site is aimed at adults with capacity to contract in their jurisdiction. Organizations accessing pages through staff accounts remain responsible for internal policies, including acceptable use and monitoring obligations under employment law.
03Informational nature of content
Articles, break patterns, program descriptions, and downloads communicate general educational approaches to office routines. They are not tailored to your health, ergonomics risk assessments, or statutory occupational safety obligations. Employers should consult qualified professionals where law mandates expert input.

04Limited license to view

08Third-party services
Fonts, icons, or future embeds may call external CDNs. Their availability and privacy practices are outside our control beyond vendor selection diligence.
09Disclaimer of warranties
The site is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law. We do not warrant uninterrupted access or error-free content.
10Limitation of liability
To the fullest extent permitted by Finnish or EU consumer law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from site use. Aggregate liability for direct damages is capped at the greater of one hundred euros or amounts you paid us for the specific deliverable giving rise to the claim within the prior six months, except if mandatory law disallows such caps for personal injury caused by gross negligence or intent.
11Indemnity
You will indemnify and hold harmless Fitcharge from claims arising out of your misuse of the site, violation of law, or infringement of third-party rights committed through your account or network, subject to procedural fairness and proportionality under Finnish civil procedure.
12Suspension and termination
We may suspend access when we reasonably suspect abuse, court orders demand it, or infrastructure maintenance requires temporary downtime. Provisions that logically survive termination—including intellectual property and liability limits—remain in force.
13Governing law
Finnish law governs these terms, excluding conflict-of-law principles that would refer matters elsewhere, except where consumer protection directives give you non-waivable rights in your habitual residence.
14Dispute resolution
Parties should first attempt good-faith negotiations. Business customers agree to the exclusive jurisdiction of courts in Finland for disputes exceeding small-claims thresholds. Consumers may also use EU ODR interfaces when applicable.
15Entire agreement
These terms, together with incorporated policies and any signed order form, constitute the entire agreement regarding the website unless explicitly stated otherwise.
16Severability
If any clause is deemed invalid, the remainder continues with modifications minimally necessary to preserve original intent.
17Changes
We may revise terms to reflect product or legal developments. Significant updates will be posted here with a refreshed date in the footer. Your continued use after the effective date constitutes acceptance unless applicable law requires explicit renewed assent.
